Terms of use

Effective October 1, 2026

1. Agreement

These terms are an agreement between you and GiftingSmart ("we", "us"), the independent project that runs the service at giftingsmart.shop. By creating an account or using the service, you agree to these terms and to our Privacy policy. If you don't agree, please don't use GiftingSmart.

2. The service

GiftingSmart lets you create gift-giving events, set budgets, keep shopping lists, record what you spend, and get alerts about prices. It's provided free of charge. We may add, change or remove features, and we may pause or stop the service, ideally with notice in the app.

3. Your account

• You sign in with a Google account. You're responsible for keeping that account secure and for activity under your account.
• You must be at least 13. If you're under the age of majority where you live, you need a parent's or guardian's permission.
• You can delete your account at any time from My account.

4. Your content

You own what you put into GiftingSmart. You give us permission to store, process and display it only as needed to run the service for you. You're responsible for what you enter, including the names of people you add, and you agree to enter only information you're entitled to use.

5. Acceptable use

Don't:

• break the law, or use the service to harass, harm or invade the privacy of anyone;
• try to access other people's accounts or data, or get around our security;
• overload, scrape, reverse engineer or disrupt the service, or use it to send spam or malware;
• enter sensitive information that isn't needed, such as payment card numbers or government ID numbers.

We may suspend or close accounts that break these rules.

6. Prices, sales and alerts

Right now, prices in GiftingSmart are simulated for demonstration and don't come from any store. Prices, price history and sale alerts are estimates for planning only. They may be delayed, incomplete or wrong, and stores can change prices at any time. Always confirm the price with the store before buying. GiftingSmart doesn't sell anything, isn't affiliated with any store, and isn't responsible for purchases you make. Budget figures and warnings depend on the amounts you enter, and aren't financial advice.

7. Links to other websites

Gift links take you to other websites that we don't control. Their terms and privacy policies apply there.

8. Disclaimer

GiftingSmart is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted, error-free or that data will never be lost. Keep your own copy of anything important; you can download your data from My account.

9. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost savings, lost data or purchases made based on information in the service. Our total liability for any claim relating to GiftingSmart is limited to CAD $50. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

10. Ending

You can stop using GiftingSmart and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering the service. Sections 4, 8, 9 and 11 continue after your account ends.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Courts in Ontario have jurisdiction over any dispute, unless the consumer protection laws where you live give you the right to go to court there.

12. Changes to these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll tell you in the app before they take effect. If you keep using GiftingSmart after that, you accept the updated terms.
